Partner Terms of Service

These Partner Terms of Service (“Partner Terms”) govern your participation in the Decision Widget partner program. By subscribing to a partner plan, you agree to these terms in addition to our general Terms of Service and Privacy Policy. If there is a conflict, these Partner Terms take precedence for partner-specific matters.

“Decision Widget,” “we,” and “us” refer to the operators of decisionwidget.net. “You” and “Partner” refer to the individual or entity subscribing to a partner plan.

1. Eligibility

• You must be at least 18 years old and have the legal capacity to enter into a binding agreement.
• You must hold a valid, active Amazon Associates account with a legitimate Associates tag.
• Your website or platform must comply with applicable laws and the Amazon Associates Operating Agreement.

2. Service Description

As a partner, you receive access to embeddable product quiz widgets with your Amazon Associates tag inserted into affiliate links. When a reader clicks a product link in your embedded widget and makes a qualifying purchase on Amazon, you earn the commission directly from Amazon under their standard Associates program terms.

Decision Widget does not process, hold, or remit commissions. Your earnings relationship is solely between you and Amazon.

3. Plans, Billing, and Cancellation

• Subscription fees are billed monthly in advance via Stripe. You authorize recurring charges when you subscribe.
• Plan changes — upgrades take effect immediately and are prorated. Downgrades apply at the next billing cycle.
• Cancellation — you may cancel at any time from your billing portal. Your subscription remains active until the end of the current billing period.
• Refunds — we do not issue refunds for partial billing periods. Cancel before your next billing date to avoid further charges.
• After cancellation, your embeds revert to the free tier (our default affiliate tag and “Powered by” badge). Your content remains live.

4. Partner Obligations

As a partner, you agree to:

• Comply with FTC guidelines — display a clear affiliate disclosure on every page that contains a Decision Widget embed with your Associates tag, as described in our Compliance Kit.
• Comply with the Amazon Associates Operating Agreement — including the required Amazon Associates disclosure statement on pages containing affiliate links.
• Use only your own legitimate Amazon Associates tag. Do not use another person’s tag or share your tag credentials.
• Provide editorial context — do not use the widget as the sole content on a page. Add your own commentary, reviews, or other original content around the embed.
• Do not misrepresent quiz results as your own editorial picks. Recommendations are generated algorithmically by Decision Widget.
• Do not place embeds on prohibited sites — including sites that rely on incentivized traffic, spam, or that violate applicable laws.
• Keep your account information accurate, including your email address and Amazon Associates tag.

5. Intellectual Property

Decision Widget retains all rights in its quiz content, scoring algorithms, product data, embed code, and branding. Your partner subscription grants you a limited, non-exclusive, non-transferable license to embed our widgets on your website(s) for the duration of your active subscription.

You may not reverse-engineer, copy, scrape, or redistribute widget content outside of the provided embed mechanism. You may not remove or obscure the “Powered by Decision Widget” attribution unless your plan includes white-label rights.

6. Data and Privacy

• We store your email address and Amazon Associates tag to operate the partner program. See our Privacy Policy for full details.
• Login codes are sent to your email via Amazon SES. We store only a hash of each code, which expires and is automatically deleted.
• We set an httpOnly session cookie ( partner_session) to maintain your login. This cookie contains no personal data and expires after 7 days.
• We do not sell, share, or use your data for purposes outside operating the partner program.

7. Termination

• By you — you may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period.
• By us — we may suspend or terminate your partner account immediately if you violate these terms, the Amazon Associates Operating Agreement, or applicable law. In case of termination for cause, no refund is provided.
• Effect — upon termination, your widgets revert to the free tier. We may delete your partner account data after a reasonable retention period.

8. Disclaimers

• Decision Widget is provided “as is” without warranties of any kind, express or implied.
• We do not guarantee any level of affiliate earnings, website traffic, search engine rankings, or conversion rates.
• Product data, prices, and availability come from third-party sources (primarily Amazon) and may be inaccurate or delayed.
• We are not responsible for changes to Amazon’s commission rates, Associates program policies, or any actions Amazon takes regarding your Associates account.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Decision Widget’s total liability to you for any claims arising from or relating to your use of the partner program is limited to the amount you paid in subscription fees during the three (3) months immediately preceding the claim.

In no event will Decision Widget be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost commissions, regardless of the theory of liability.

10. Indemnification

You agree to indemnify and hold harmless Decision Widget from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from your use of the partner program, your violation of these terms, your failure to comply with FTC guidelines or the Amazon Associates Operating Agreement, or your website’s content.

11. Modifications

We may update these Partner Terms at any time. Material changes will be communicated via email to your registered partner email address. Your continued use of the partner program after changes take effect constitutes acceptance of the updated terms.

12. General

• These Partner Terms, together with the general Terms of Service and Privacy Policy, constitute the entire agreement between you and Decision Widget regarding the partner program.
• If any provision is found unenforceable, the remaining provisions remain in full force.
• Our failure to enforce any right does not waive future enforcement of that right.
• These terms are governed by applicable law. Any disputes will be resolved through binding arbitration or small claims court, at the election of either party.
